In Estonia, marriage is concluded between an adult man and adult woman. A minor between the ages of 15 and 17 can get married, if the court has expanded his/her active legal capacity to get married.

An adult with restricted active legal capacity may marry if it follows from the ruling concerning the appointment of a guardian that he/she understands the legal consequences of marriage. A marriage shall not be contracted between persons of whom at least one is already married, relatives in ascending or descending line, between brothers and sisters and half-brothers and half-sisters, adoptive parents and adoptive children, as well as adoptive children adopted by the same person.
